Untested, but:

In [catalog]pages/ord/checkout.html:

Find: <SELECT NAME=mail_list>
Remove that line and about 12 more, including </SELECT>

After that, It's no longer an option for them to respond to.

If it bugs you, you can go into [catalog]etc/report and remove the
offending phrase, which will be blank on all of your orders.
